DMCA Notice & Takedown Policy

1. Overview

xproxy respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We respond to properly submitted notices of alleged copyright infringement in accordance with the DMCA.

2. How to File a DMCA Notice

If you believe that content accessed through our service infringes your copyright, please send a written notice to our designated DMCA agent containing:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it (e.g., IP address, timestamp, user identifier if available).
  4. Your contact information (name, address, telephone, email).
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Our Response Process

  1. Acknowledgment: We acknowledge receipt of the notice within 24 hours.
  2. Review: Our team reviews the notice for completeness and validity.
  3. Action: If valid, we take appropriate action which may include:
    • Blocking the identified IP address or node from our network.
    • Terminating the account of the user associated with the infringing activity.
    • Preserving relevant logs for law enforcement (connection metadata only, per our no-activity-log policy).
  4. Notification: If possible, we notify the affected user of the takedown.

5. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  4. Your name, address, telephone number, and consent to jurisdiction.

6. Repeat Infringers

In accordance with the DMCA and our Terms of Service, we maintain a policy of terminating accounts of users who are repeat infringers in appropriate circumstances.

7. Limitations

As a VPN service with a strict no-activity-log policy, our ability to identify specific users or content may be limited. We cooperate to the fullest extent possible within the constraints of our privacy architecture and applicable law.
